Handoff Labs AI ("we", "us", "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our application. We are an online startup registered in Georgia. By using our Service, you agree to the collection and use of information in accordance with this policy.

2. Compliance (COPPA & FERPA)

• COPPA:We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13 without verifiable teacher, school, or parental consent. If we become aware that we have collected Personal Data from a child under age 13 without verification of teacher, school, or parental consent, we take steps to remove that information from our servers.
• FERPA:We support schools' compliance with the Family Educational Rights and Privacy Act (FERPA) by protecting the confidentiality of student education records and using such records only for legitimate educational purposes.

3. Information We Collect

• Personal Data: Personally identifiable information, such as your name, email address, and school affiliation, that you voluntarily give to us when you register.
• Usage Data: Information automatically collected when you access the Service, such as your IP address, browser type, operating system, access times, and the pages you have viewed directly before and after accessing the Service.
• Verification Data: Information required for spam checks and identity verification (e.g., phone numbers for audits).
• LMS Data: If you connect an external Learning Management System (such as Google Classroom, Canvas, etc.) to Tally, we collect and process information required to provide our service. This includes:
  • Your profile email address (to identify and link your account).
  • Course and class lists (to set up your class dashboard).
  • Roster information and student names (to create student profiles).
  • Assignments and coursework details (to import tasks to grade).
  • Student submissions and grading data (to draft AI grading and feedback).

4. How We Use Your Information

We use the information we collect to:

• Provide, operate, and maintain our Service.
• Improve, personalize, and expand our Service (analytics).
• Understand and analyze how you use our Service.
• Develop new products, services, features, and functionality.
• Communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the Service.
• Verify your identity and prevent fraud.
• WE DO NOT SELL YOUR DATA.

We may share information we have collected about you in certain situations. Your information may be disclosed as follows:

All third-party sub-processors (such as artificial intelligence service providers used for grading assistance) are contractually bound to keep your data confidential and are strictly prohibited from using your data to train their models.
• Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

6. LMS & Google Classroom Data Retention & Deletion

We retain information fetched from Learning Management System APIs to provide our educational service. You can disconnect your LMS integration at any time to prevent further data syncing. Synced LMS data will be retained on our servers to preserve your historical records and dashboard metrics; however, you can request the permanent deletion of your synced LMS data or your entire account at any time by contacting us at support@handofflabs.ai.

7. Data Security

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.

8. Data Retention

We retain your personal information to provide the educational service, maintain historical records, and support account functionality. We will retain this information until you request its deletion, or as long as necessary to comply with our legal obligations, resolve disputes, and enforce our policies.

9. Your Privacy Rights

Depending on your location, you may have the right to access, correct, or delete the personal information we hold about you. You may verify and update your account information by logging into your account settings.

10. Policy for Children

We do not market to or build advertising profiles for children under the age of 13. Tally only collects personal information from students under 13 when authorized by their teacher, school, or district to provide the educational service, or with verifiable parental consent. If you believe we have collected information from a child under 13 without such authorization or consent, please contact us at support@handofflabs.ai so we can delete it.
